The short version: Monthly plans have a 12-month minimum term and renew monthly after that until you cancel. You keep your domain and the content you provide. Each monthly update covers one small change of up to 30 minutes, and unused updates don't roll over.
1. About these terms
These Terms of Service ("Terms") apply when you create an account with, or buy a plan from, The Website Builder ("we", "us", "our"). By creating an account or completing a purchase, you agree to these Terms and our Privacy Policy. If you're buying for a business, you confirm you're authorised to accept these Terms for that business.
2. Plans & scope
We offer the plans described on our Pricing page:
- Website Launch: a one-time build of up to 5 pages. You provide the domain, hosting (with SSL), content and branding.
- Website Essentials: a managed monthly plan with up to 5 pages, one eligible domain, hosting, SSL, up to 10 email accounts, maintenance and one update per month.
- Website Pro: a managed monthly plan with up to 10 pages, advanced on-page SEO setup, analytics, selected prebuilt modules, expanded email hosting and three updates per month.
Features are subject to the plan limits, eligibility and fair use described on our Pricing page. Work outside a plan's scope, such as extra pages, redesigns, custom functionality, e-commerce or ongoing SEO campaigns, is quoted separately before we start.
3. Getting started & delivery
After payment, you'll complete an onboarding form in your account. Delivery times shown on our Pricing page are estimates in business days. They start once we've received all the materials we need (content, logo, images and domain details). Delays in providing materials or feedback will extend delivery.
We'll share your site for review before it goes live. Revisions during the build should stay within the agreed scope.
4. Billing & payment
- Payments are processed securely by Stripe. We don't see or store your full card details.
- Prices are in Canadian dollars (CAD), and applicable sales taxes are added at checkout.
- The Website Launch plan is paid in full up front.
- Monthly plans are billed in advance and renew automatically each month on the same date until cancelled.
- If a payment fails, Stripe will retry it, and we'll ask you to update your payment method. If payment remains overdue for more than 14 days, we may suspend your website and email until the account is brought up to date.
You can update your card and download invoices any time from your account.
5. Minimum term & cancellation
- Website Essentials and Website Pro have a 12-month minimum term starting on your first payment.
- After the minimum term, your plan continues month to month.
- Once the minimum term has ended, you can cancel at any time from your account. Cancellation takes effect at the end of the current billing period, and your site stays live until then.
- If you need to cancel before the minimum term ends, please contact us. You remain responsible for the remaining monthly payments of the minimum term unless we agree otherwise in writing.
- We may end a plan with 30 days' written notice, or immediately for serious breaches of these Terms (for example, illegal content or non-payment). If we end a plan for reasons other than your breach, we'll refund any amount you've prepaid for the unused period.
6. Refunds
- Website Launch: if you cancel before we begin design work, we'll refund your payment in full. Once design work has started, the fee is non-refundable.
- Monthly plans: monthly fees are non-refundable, and we don't provide refunds or credits for partial months.
- Nothing in these Terms limits any rights you have under applicable consumer protection law.
7. Monthly updates
Monthly plans include update credits: 1 per month on Essentials and 3 per month on Pro. Each credit covers one small content change of up to 30 minutes, such as changing text, hours, prices or contact details, replacing an image, or making a small adjustment to an existing section.
Credits reset each calendar month and don't roll over. New pages, redesigns, new functionality and extensive copywriting aren't covered by credits and are quoted separately. Website Launch includes up to three minor revision rounds within two months of delivery.
8. Domains, hosting & email
- Monthly plans include registration and renewal of one eligible standard domain (for example, .ca or .com) while your plan is active, subject to an annual cost limit. Premium domains or additional domains cost extra.
- Domains we register are registered in your name. When you leave, we'll help you transfer the domain to the registrar of your choice.
- Hosting and email are provided on a fair-use basis, with the mailbox, storage and sending limits of your plan. Email hosting doesn't include Microsoft 365 or Google Workspace.
- We aim for reliable service but don't guarantee uninterrupted availability. Scheduled maintenance and issues with third-party providers can cause occasional downtime.
9. Ownership
- Your content: you keep ownership of your domain, text, logos, photos and other materials you provide.
- Website Launch: once paid in full, you own the website files we deliver for your use.
- Monthly plans: the website design, code and templates are licensed to you for as long as your plan is active. If you leave after your minimum term, we can provide an export of your site or help you migrate it. What's included in an export depends on the platform, and a migration fee may apply. We'll quote it in advance.
- We may show your website in our portfolio. Just let us know if you'd prefer we didn't.
10. Your responsibilities
- Provide accurate information and the materials we need on time.
- Make sure you have the rights to all content you give us, including images, logos and text.
- Don't use our services for anything illegal, harmful, misleading or that infringes others' rights, and don't send spam from our email services.
- Keep your account password secure, and tell us promptly about any unauthorised use.
11. Warranties & liability
We provide our services with reasonable care and skill. Search engine optimisation improves your website's technical foundations, but we can't guarantee search rankings, traffic or sales.
To the extent permitted by law, we aren't liable for indirect or consequential losses, such as lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
12. Changes to these terms or prices
We may update these Terms or our prices from time to time. For existing customers, we'll give at least 30 days' notice by email before a change affects you. Price changes won't apply during your initial 12-month minimum term.
13. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there.
